The L.A. County Fire Department was called to the scene of a serious personal injury at Universal City Walk last Saturday morning. Officials say that a man fell from the second story of the Jurassic Park parking lot structure at around 1:15 am. The extent of the victim’s injuries has yet to be disclosed, but Dispatch Supervisor Michael Pittman says he was transported to the hospital.

The investigation could uncover evidence that the fall was caused by a pre-existing hazardous condition that could have been averted if owners had taken appropriate action.

A simple netting in the gap between the false wall would have been an easy fix to this obvious safety issue, but no measures were taken after the first accident last year. This type of inattention gives rise to a strong premises liability claim since the property owners were aware of the parking lot structure dangers but were negligent in remedying the problem.

Just eight months ago, another guest at Universal City Walk fell 40 feet from a parking lot structure in the exact same spot. The ledge, which is just wide enough to sit on, has a false wall behind it leading people to believe they are protected, when in fact they are not. The massive tumble resulted in a fractured pelvis and more than $400,000 in medical bills for the girl, who is represented by Los Angeles Personal Injury lawyers at Ellis Law firm.

The majority of successful slip and fall lawsuits and premises liability cases are dependent on whether the owner knew of the hazard beforehand, but was not prompt or diligent in making it safe.  Our client was injured at Universal City Walk’s parking structure nearly eight months ago – plenty of time for property owners to take action.

Falls from great heights often result in grave, permanent injuries.  And hospital bills for broken bones and internal injuries can quickly run in to the six figures, as was the case with our client. On top of medical and rehabilitation costs, victims are also burdened by a loss of income, creating a recipe for financial ruin. Fortunately, the law affords protection for such injuries, as property owners are legally obligated to maintain a safe and hazard-free environment for visitors, or invitees.
