On January 22, Playtex, a unit of Energizer Holdings, publically announced a product recall. The Playtex pacifier holder recall covers over 1.4 million units distributed through, Wal-Mart and other major retailers from July 2010 to October 2013.

The concern is that a small piece of the holder clip could break off and become a choking hazard to small children. Playtex spokesperson Catherine McCormack said, “We are taking this action out of an abundance of caution, because our top priority is the health and safety of the people who use our products.”

According to the U.S. Consumer Product Safety Commission, this particular model was distributed in green with a monkey figure, pink with a flower, and blue with a tow truck. The clips feature a plastic clip with the figure and a “Playtex” copyright logo.  These parts slide up and down to adjust the clip. As of the date of the recall, Playtex has received 99 reports of the clip cracking or breaking.

Playtex has asked that concerned parents call them directly or contact representatives on their website. This is fine if you are simply looking for a refund for a potentially dangerous product.

If, however, your child has been injured, you should contact an attorney as soon as possible. Even if you did not purchase the defective clip, if the Playtex pacifier clip injured your child, you have a right to compensation for your losses by filing a product liability lawsuit.

Who is eligible to file a product liability lawsuit ?

In general, four factors must be met for an individual to be legally entitled to file a product liability lawsuit. The individual must have been injured or suffered losses directly related to the product. The product must be defective. The defect must have been the cause of the injury or loss. And the product must have been being used as it was intended.

In the case of the Playtex pacifiers, the product has been found to be defective. The small part that can break or come loose can cause a serious choking hazard during normal use. If your child suffered harm from this small piece of broken clip, you have the right to seek damages in a product liability claim.

Compensation for victims of defective products

When a corporation issues a voluntary product recall, it has effectively admitted that their item poses safety hazards to the public. Therefore there is a very strong possibility that a lawsuit filed on behalf of the injured party will be successful in pursuing damages.

Corporate lawyers are in the business of saving their clients money, so in cases like these settlement offers generally center around paying for medical expenses. However, without a lawyer of your own, this may be the extent of your compensation.
