The reputable Insurance Institute for Highway Safety (IIHS) recently released a paper studying the rise in pedestrian fatalities during 2009 to 2016. The authors found that, during this short time period, 46% more pedestrians lost their lives in accidents compared to previous years. The surge in fatalities is alarming to public safety advocates, some of whom have suggested technological and road design improvements that may help curb this rising trend.

Public safety study reveals alarming safety failures

The study authors evaluated data extracted from the Fatality Analysis Reporting System and General Estimates System. They examined the linear progression of changes during the study period in both pedestrian deaths per 100 crash involvements and in horsepower per 1,000 pounds of weight. Poisson regression was examined to evaluate factors such as roadway, environmental, personal, and vehicle.

The results indicated that, during the study period, pedestrian deaths reached their low period in 2010. From 2010 to 2015, pedestrian deaths per 100 crash involvements increased 29%. During the entire study period, the largest increase in pedestrian deaths occurred in urban regions. This represented a 54% increase. On arterial roadways, there was a 67% increase in deaths, and at non-intersections, there was a 50% increase in deaths. Crashes in dark conditions increased too, with a 56% rise in fatalities. Additionally, the number of SUV involved in fatal pedestrian accidents increased by 82%.

Suggestions for safety improvements

The authors at the IIHS concluded their study by suggesting that transportation agencies focus their efforts on areas that represented the greatest increases in pedestrian fatalities. Specifically, the authors recommended that urban arterials be improved by road diets, median crossing islands, pedestrian hybrid beacons, and automated speed enforcement. The visibility of pedestrians during nighttime hours could be enhanced with better vehicle headlights and better roadway lighting.

Pedestrian fatalities in California: A look at the recent statistics

Here in Los Angeles, Mayor Eric Garcetti recently launched a high-profile campaign to end traffic fatalities entirely. The overall number of traffic fatalities, including pedestrian deaths, has indeed fallen slightly. Recent statistics show that during 2017, there were 244 traffic fatalities, including drivers, motorcyclists, bicyclists, and pedestrians. This is a six percent decline in traffic accident deaths.

However, pedestrian fatalities have surged in Los Angeles. In 2015, 74 pedestrians were killed on the city’s streets. During 2017, that number increased to 134.

In a statement to the Los Angeles Times, Mayor Garcetti said, “Every life is important and we must keep pushing to do better. Safety is our top priority, and we will continue to set bold goals.”

ambulanceTwo people were sent to the hospital as a result of a car that crashed through fences and the kitchen and dining room of a home in Redlands on May 8. Deeming the home unsafe to occupy in the wake of the accident, California authorities red-tagged it.

The Redlands Police Department arrested the driver, Jason Robert Sheridan, 27, on suspicion of driving under the influence (DUI).

Redlands home will have to be rebuilt after crash

An occupant in the home, a 60-year-old woman, suffered facial lacerations and was sent to an area hospital. So was a passenger in Sheridan’s vehicle, a Dodge Challenger. Both the 55-year-old brother and 87-year-old mother of the injured woman were also in the home during the crash, but escaped injury.

The man, Lee Hernandez, was in tears after the accident. His parents purchased the house in 1950 and he grew up in it along with 4 sisters. He plans to rebuild it.

Hernandez indicated that he hears racing up and down streets around the home, which is near Clay Street and Brockton Avenue, and heard “tires screeching and metal crunching” right before the car hit his home, according to NBC News. “The crunch kept going, it was unbelievable.”

Although the Challenger hit at least one fence before ramming into Hernandez’s home, police said there was no evidence to indicate that Sheridan was racing or even driving at high speeds.

The property was littered with debris after the accident.

Liability in the case of a DUI

California law on DUIs is very strict. A driver who caused an accident due to a DUI can be given a jail sentence of up to 6 months and be fined up to $1,000 if it is a first offense. The arrest stays on the driver’s record for 10 years.

The penalties climb steeply after the first offense.

Drivers arrested for a DUI in California can also be prosecuted for ordinary negligence or gross negligence. Ordinary negligence means the person did not act with proper care, and gross negligence is acting with extreme disregard for the safety of others.

Blue flasher on the police car at night.A horrific car crash has left two dead and one in critical condition. The accident happened in Inglewood at around 9:23 a.m. on Thursday, May 10. It occurred close to the county fire station, near the intersection of Crenshaw Boulevard and 107th Street. Although the firefighter-paramedics immediately rushed out to assist the victims, aided by bystanders, one of the victims had already died and was pronounced at the scene. CPR was unsuccessfully administered to the other victim.

The third, surviving victim was extricated from a vehicle by an off-duty firefighter. The individual reportedly sustained a broken leg and was in critical condition when taken to a local hospital.

Speeding may have been a factor in the crash

According to eyewitness statements and preliminary remarks by law enforcement officials, an Infiniti was heading northbound on Crenshaw Boulevard. The Infiniti then struck an oncoming car as this second vehicle was making a left-hand turn. The oncoming car, only described as a white vehicle, contained the two victims who did not survive.

The force of the impact was strong enough to land the vehicles about a block apart from each other. “It seemed as if it was a blast, you know. Like a bomb,” said one witness, referring to the sound of the crash. Both of the vehicles became engulfed in flames when one of the gas tanks ruptured.

Security footage from along Crenshaw Boulevard indicated that the Infiniti had been traveling much faster than other vehicles heading in the same direction, and one of the officials on the scene said that speed was being considered as a possible factor in the crash.

It’s unknown whether substance-related impairment could also have been a factor. One witness, who had been driving northbound alongside the Infiniti, said that its driver had been attempting to flirt with her. The woman said she ignored him, and then the driver of the Infiniti sped off. She further stated that the Infiniti was being driven erratically, and nearly rear-ended a separate vehicle prior to the horrific crash. Skid marks found at the scene suggested that the driver did try to slow down prior to striking the white vehicle.

Liability considerations in car accidents

It is estimated that around 120 construction workers die every year when doing road construction. The shocking part of that statistic is that almost half of those deaths are caused by other construction workers. Summertime means road construction, and road construction means worker safety issues. When you understand why these construction accidents happen, it becomes easier to prevent them.

When Construction Sites Become Danger Zones

Road construction sites become dangerous for many reasons. Construction vehicles are equipped with back-up alarms that are supposed to warn workers when a truck is backing up, but those alarms become background noise in a work area where car horns can be heard constantly.

When a road construction site is on the opposite side of the flow of traffic, workers are usually forced to park in an area that has them crossing many lanes of traffic to get to the job site. The process of moving workers and equipment into the work area becomes dangerous for everyone involved.

Construction companies should invest in backup cameras for their trucks and put together safe ways to move workers and equipment from parking areas to the work site. When safety details are planned out properly, it can prevent accidents.

Danger From A Distracted Public

It is estimated that 10 percent of the construction workers who are killed on road job sites are struck by distracted drivers. During the summer, construction workers become accustomed to wearing sunglasses or goggles with tinted lenses to protect their eyes from the sunlight. But when there is no sunlight, wearing tinted lenses can create a serious worker safety issue. Construction companies should get used to regulating the use of sunglasses and making sure that workers put safety over style.

Be Extra Vigilant When Supervising Night Work

Many construction companies work shifts around the clock to get road projects completed by their deadlines. This means night work, and that brings a whole new set of responsibilities. Supervisors need to be sure that every worker is wearing their reflective clothing and that workers are well-rested when the shift begins. A loss of focus during night work on a road construction site creates a serious safety hazard for every worker.

The statistics show that road construction during the summer is dangerous for workers and the public. Construction companies need to take the necessary steps to prevent construction accidents and enhance worker safety during these busy months.

Traumatic brain injuries (TBIs) are serious and potentially life-threatening. They can cause hallucinations, mood disorders such as depression, paralysis, impaired cognitive function, memory loss, and more.

These symptoms can be treatable. If they are treated, the quality of life of TBI patients can be measurably improved.

But at times, TBIs go completely undiagnosed. Why? There are 3 reasons.

#1. They are misdiagnosed.

Because TBIs cause multiple symptoms, and symptoms are often how doctors arrive at a diagnosis, the symptoms may cause a misdiagnosis. Hallucinations, for example, can be caused by seizures whose ultimate cause was a TBI. But a patient may be diagnosed with epilepsy or mental illness like schizophrenia rather than a TBI.

In some cases, anti-seizure medication will effectively treat the symptoms. In others, however, the treatment may not work. A patient given treatment for mental illness whose actual problem is TBI-related seizures won’t be helped by the medication.

Diseases like Alzheimer’s and other forms of dementia may have started with a TBI.

#2. Causal factors aren’t completely understood.

Despite the increasing attention paid to TBIs and their consequences, the general public still doesn’t fully understand the causal factors.

Most people know, for example, that concussions can cause traumatic brain injury. But repeated hits to the head may cause TBI, even when they aren’t sufficient to cause concussions. These kinds of hits, called “subconcussive”, are equally dangerous and need to be avoided in sports, for example. If they occur, a doctor should be consulted.

#3. The people who suffer from TBIs are homeless.

People in southern California know that we have a large homeless population. What’s less well known is that a surprisingly high percentage of homeless people have had a brain injury in the past sufficient to cause TBI. Studies in the U.S. and Canada have found that up to 67% of the homeless population studied experienced a significant head injury before they became homeless.

This correlation has only recently begun to be studied. But it’s important to know, because the very symptoms that contribute to making people homeless — inability to remember to pay bills on time, keep a job, anger management, and substance abuse — may stem at least partly from TBI. Traumatic brain injury can affect memory, functioning, cause pain and hallucinations that the person medicates with drugs, and cause anger issues.

Illuminated hotel sign Whether you’re in a hotel for pleasure or for business, there are multiple ways you can injure yourself via a slip and fall. Here are some of the most common hotel slip and fall accidents:

1. Slipping on the Ice

Some hotels often have long, landscaped walkways. If you are visiting in cold weather, snow and ice may make the walkways dangerous. You can sprain an ankle, break a leg, or even suffer a concussion due to slipping on the ice.

2. Slipping Near a Jacuzzi

Jacuzzis are one of the great perks of hotels. But areas proximate to and around Jacuzzis (as well as swimming pools) can be wet and slippery. You could slip and fall as a result of the wetness.

3. Falling in the Hallway

If a hotel’s carpet is torn, you could slip and fall, especially if the torn area is sticking up and acts as an impediment to people walking over it.

Is the Hotel Liable?

Is a hotel liable for your injuries when you slip and fall on their premises?

The law here is clear. Hotels are businesses, and all businesses have a duty of care to those who frequent them or might be on their premises for any reason. As part of the duty of care, they must inspect their facilities and property regularly to make sure that the premises is in safe condition. If the hallway or other carpet is torn, is could be dangerous and needs to be replaced.

In addition, they must make sure that any suddenly occurring conditions that could make their premises or property dangerous to patrons are made safe. So if snow or ice occurs, it must be cleared from walkways promptly. If a hotel employee spills a drink while serving, the liquid must be cleaned up promptly so that patrons don’t slip in the liquid.

In a premises liability case, a court will examine whether the hotel knew or reasonably should have known about an unsafe condition. Then they will examine whether the hotel made the unsafe condition safe as soon as they knew about it. These are the two establishing conditions for premises liability.

The hotel can argue that they couldn’t reasonably have known that a condition was unsafe, or that they didn’t have time to rectify an unsafe condition.

If a hotel guest leaves a pair of Crocs near a Jacuzzi, for example, and the next guest trips over them, the hotel might not be found liable, because they could not have reasonably known that the Crocs were there.

If walkways were not icy at 10 a.m. and a slip and fall occurs at 10:20 a.m., the hotel could argue that they didn’t have sufficient time to realize that the conditions had changed and become icy.

Falls are scary no matter what age you are, but they are particularly dangerous among older adults. In fact, falls are the number one cause of accidental death, brain injury and hospital admissions among the elderly in the United States.

According to a new report by government researchers, rates of brain trauma and concussions from falls in our senior population have soared in recent years, hitting record levels since 2007.

Fall-related brain injuries

It’s well known that older people are more susceptible to fall-related injuries than their younger counterparts. This is because most seniors become more sedentary as they age, are more likely to have impaired vision and no longer have the agility and quick reflexes to regain balance. In addition, the majority of older Americans are taking some type of prescription medication – including antidepressants, diabetes medications, sedatives, and heart drugs – that can cause low blood pressure, fatigue and dizziness.

Whatever the culprit, the rates of fall-related brain injuries among our seniors are alarming. The Centers for Disease Control and Prevention recently reported that 1 in every 45 Americans age 75 or older sustained brain injuries leading to hospitalization or death in 2013. This figure marks a 76 percent spike compared to 2007.

More older Americans living at home

The researchers found that elderly people who choose to live at home are falling more often, putting them at greater risk for concussions and other physical harm. However, they are often reluctant to tell their loved ones about repeated tumbles for fear of losing their independence. Older family members may downplay a slip in the bathtub or a tumble down the stairs, but in doing so, they may not be getting the urgent medical attention necessary to diagnose and treat head injuries.

Research shows that one fall usually leads to others, and in one published study, more than 33 percent of seniors who suffered minor head injuries wound up back in the emergency room within 3 months.

Why are more elderly falling?

Besides OTC and prescription medications that worsen balance, an overall decline in physical fitness, and impaired vision, these are some of the other factors that contribute to falls in elderly:

  • Health conditions such as dementia, Parkinson’s, Alzheimer’s disease, peripheral neuropathy and arthritis

Thirty-year-old Jose Manuel Garcia, the driver accused of causing the accident, was arrested on charges of gross vehicular manslaughter while intoxicated and three felony counts of murder. The crash occurred in south Los Angeles in Vermont Knolls.

Horrific accident tears apart family of 5

A family was traveling in their blue Dodge Caravan that Saturday. They were passing through the intersection at South Hoover and West 76th Streets when Garcia’s black Nissan Xterra SUV ran the red light and broadsided the van. An eyewitness told reporters that the van was dragged about 25 feet down the street. It burst into flames upon striking a curb.

Within moments of the crash, bystanders were running toward the wreckage trying to help the survivors. “It was terrible. I had to see these two little boys,” said eyewitness Bobby Arredondo.

Three of the family members could not be saved. The accident claimed the lives of the father, Juan Reynoso, age 34, his six-year-old daughter, Emma Reynoso, and his five-month-old son, Sebastian Reynoso. The unidentified mother and another sibling, nine-year-old Julian Reynoso, both sustained critical injuries.

Early reports after the crash suggested that Jose Garcia also sustained serious injuries.

DUI suspect to appear in court

On Wednesday, May 2, suspected drunk driver Jose Garcia is expected to appear in court. Prosecutors have recommended that bail be set at no less than $6 million. Along with the charges of manslaughter and murder, Garcia faces a charge of driving with a 0.08 percent blood alcohol content (BAC) causing injury within 10 years of another DUI, and a second charge of driving under the influence of alcohol within 10 years of another DUI offense. Both are felony offenses.

If convicted of all charges, Garcia would face a possible sentence of 82 years to life in prison.

It’s not known if Garcia will face any other potential legal consequences for another accident he’s alleged to have caused. It took place shortly before the deadly crash at the intersection. A witness who lives just down the street has claimed that Garcia struck her neighbor’s vehicle. “We screamed at him, ‘Hey!’ and he just took off,” said Alma Munoz.

Legend has it that the inventor of the revolving door came up with the idea because he didn’t like to hold doors open for women. In actuality, Theophilus Van Kannel just wanted to invent a door that would keep out snow and rain, and wouldn’t be blown open by the wind.

Regardless of the true nature of its origin, revolving doors today are known for their convenience and their potential to cause disabling and life-threatening injuries.

Facial trauma

Some of the most common injuries caused by revolving doors involve the face. Incidents involving revolving doors have been reported in which pedestrians suffered broken noses and fractured teeth. These injuries can occur with either motorized or manual automatic doors. During one incident, for example, a mother pushing a stroller was entering a building, and a woman was exiting the building while talking on her cellphone. The motorized, automatic door stopped just as it was supposed to because it sensed the presence of the stroller in close proximity to the door. The woman who was exiting the building smashed her face into the glass panel. The glass panel broke, and so did two of her front teeth.

A similar accident occurred in which an elderly man was entering a building while two young ladies were exiting. The women were distracted by their conversation, and had positioned themselves very close to the panel while walking. The man entering the building came in close proximity with the crush protection sensor, which responded by halting the movement of the door panels. This caused one of the ladies to walk into the door panel, breaking her nose.

Hip fractures

At least two revolving door accidents have caused hip fractures, which are known to be among the most disabling and even life-threatening types of injuries among seniors. A 91-year-old literary agent in New York City, Marianne Strong, filed a personal injury lawsuit after a revolving door caused her to be propelled out from the building. She landed on the sidewalk and broke her hip.

In 1997, former San Francisco 49ers football star Vincent Rovetti was struck by a revolving door at the San Francisco Marriott. He fell and broke his hip. During the subsequent surgery, Rovetti suffered a fatal heart attack.

Skull and brain injuries

Skull and brain injuries are among the most fatal injuries caused by revolving doors. In one incident, a 19-month-old boy had his arm caught in a narrow gap in a revolving door. Efforts to free the arm only resulted in the boy being dragged farther into the gap. By the time he was finally rescued, resuscitation efforts were futile. He was declared dead from compression injuries of the skull and brain, as well as thoracic compression.

A deadly crash in 2017 on the 605 Freeway in Whittier has led to the arrest of an off-duty LAPD officer. The officer, 27-year-old Edgar Omar Verduzco, of Santa Ana, was charged with three counts each of murder and gross vehicular manslaughter while intoxicated, as well as drunk driving causing injury. He has also been discharged from his duty as an officer.

Speed and alcohol believed to be factors

The crash took place last year on September 26, around 10:15 p.m. Verduzco was driving a 2016 Chevrolet Camaro, headed southbound on the 605 in the carpool lane at an excessive speed. He had reportedly posted a video from a bar to his social media account just hours before the crash and CHP officers at the scene determined he was intoxicated based on field sobriety tests.

At the time of the accident, in the lane ahead of Verduzco, a 2014 Nissan was carrying three members of a family from Riverside – 52-year-old Maribel Davila, her 60-year-old husband Mario, and their 19-year-old son Oscar. A 2010 Scion driven by 32-year-old Berly Alvarado of Wilmington, accompanied by her 1-year-old son, was also traveling in the lane.

Three family members killed in DUI crash

According to investigators, while Verduzco was speeding, he struck the Nissan carrying the Davila family and their vehicle was launched toward the freeway divider wall where it caught fire. Verduzco’s vehicle then struck the Alvarado vehicle.

The Verduzco and the Alvarados were transported to the hospital with non-life-threatening injuries but all three members of the Davila family were killed in the crash. According to a fundraising site, the Davilas were actively involved in their community and left behind four other children.

This crash illustrates the serious consequences of drunk driving. Though arrests for DUI have steadily declined, the proportion of fatal crashes involving alcohol have increased to nearly 40%.

The law allows victims – both those personally involved in the crashes and the loved ones left behind because of a fatal DUI crash – to hold the driver and/or the establishment that served him or her alcohol responsible.
