How Long Do I Have to File a Claim in California?

You have up to TWO YEARS from the date of your accident to file your claim for legal compensation, given California’s Statute of Limitations law. Medical malpractice claims allow you up to THREE YEARS from the date of injury OR up to ONE YEAR from the discovery of injury. However, it is always best to speak with a Beverly Hills attorney, as the law does allow for several exemptions.

For instance, the parents may not have sued for damages from a birth injury, but the child may choose to sue when he or she comes of age at 18 (or emancipation.) In other birth injury cases, the full extent of the injuries were not evident until the child reached school-age and underwent testing for cognitive delays. The statute is extended to six years after the date of birth for these lawsuits.

Sometimes people are injured in accidents, but die as a result of those injuries some time later, prompting a wrongful death suit within six months of death, if outside the normal Statute of Limitations.

Mentally incompetent victims may be granted an extended filing deadline.
