Greyhound-Foothill commuter bus crash liability

Representatives for Greyhound confirmed they will be conducting an independent investigation into the accident.  What we know from California Highway Patrol and aerial footage from the scene is that the Greyhound bus, carrying 38 passengers, struck the rear bumper of the transit bus as it was slowed down on the eastbound Express Lane. It is uncertain if the driver of the Greyhound bus was applying his brakes at the time of the collision or tying to maneuver around the transit bus.

Bus drivers are held to a higher duty of care when transporting passengers, and as such must exercise reasonable caution to prevent injury or harm. As authorities delve deeper into the causes of this bus accident, special care must be taken to establish which party or parties are responsible.

Liability may hinge upon a number of factors, including:

  • Weather and road conditions
  • Driver error
  • Vehicle speed
  • Driver fatigue
  • Mechanical failure
  • Negligent maintenance
  • Driver distraction
